Our Brisbane and Gold Coast commercial litigation team are experienced in all aspects of Professional Negligence.
We act for plaintiffs and defendants where allegations are made in respect of professional negligence.
Negligent advice can be given by professionals including (but not limited to) accountants, lawyers, financial planners and advisors, building inspectors, engineers or other professionals or licensed tradespeople. Although it is unfortunate when one receives negligent advice and suffers loss, it is important to vigorously pursue any claim for damages as most professionals hold professional indemnity insurance that will respond to such a claim.
It is also important that you obtain advice immediately upon becoming aware that the professional advice may have been negligent, as there are strict timeframes within which an action for professional negligence can be made.
Our firm has experience in running large Supreme Court and Federal Court damages claims for negligent acts of professionals, and in achieving remarkable commercial outcomes for clients in these matters.
We also regularly assist clients through the relevant tribunals, Government authorities (including the Australian Financial Complaints Authority (“AFCA”)) and the Ombudsman jurisdiction if this is appropriate.
We regularly advise and act in relation to:
(i) Body Corporate by-law interpretation, disputes and enforcement;
(ii) Contractual disputes between the Body Corporate and third parties including on-site managers, caretakers and administrators;
(iii) Defamation of committee members or lot owners arising from Body Corporate matters;
(iv) Governance and compliance with the Body Corporate and Community Management Act 1997 and the Building Units and Group Titles Act 1980;
(v) Appointment of administrators to the Body Corporate;
(vi) Adjudication applications to the Commissioner’s office for all matters under the Act and Regulation Modules;
(vii) Conciliation and dispute resolution; and
(viii) Debt recovery on behalf of the Body Corporate against lot owners and third party contractors, including recovery of the Body Corporate’s legal fees.
